The HC bench of Justice Farid Ahmed and Justice ASM Abdul Mobin refused to hear the petition and dropped it from the cause list.
The senior judge of the bench said the appeal should be filed with the Appellate Division as another HC bench already delivered its order after hearing the bail plea previously.
But Khaleda’s lawyer Advocate Zainul Abedin said although the HC previously heard the petition, there was no obstacle for a fresh HC bench to hearing it again.
He took back the petition when the HC declined to hear the matter again.
On July 31, HC rejected bail petition of Khaleda while on September 3, her lawyers again filed fresh bail petition with the HC.
A special court jailed the BNP chief and three others for seven years in the corruption case on October 29 last year.
On August 8, 2011, the ACC filed the Zia Charitable Trust graft case with Tejgaon police accusing four people, including Khaleda, of abusing power in raising funds for the trust from unknown sources.
The former prime minister has been in prison since February 8 last year after she was sentenced to jail for five years in the Zia Orphanage Trust corruption case.
Khaleda later moved the High Court which increased her sentence by five more years.
