The HC bench of Justice Md Rais Uddin and Justice Md Jahangir Hossain also asked the assistant public prosecutor (APP) of Dhaka Metropolitan Special Tribunal–2 to appear before it on July 3 along with the judge to explain their stance.
On April 30, the High Court stayed the proceedings of the case filed for possessing arms and ammunition for three months after lawyer Md Ashraful Alam filed a petition attaching a newspaper report on the agony of elderly Rabeya Khatun.
The court also sought explanation within two weeks for the delay in the trial proceedings of the case and issued a rule as to why the case should not be cancelled.
However, the HC came to know today that the trial court continued to hear the case defying its stay order and it conducted four hearings by the time since the stay order.
Prime accused of the case Julhas Mia has already died while Rabeya who was shown 77 in the case documents but she claimed herself to be 104 years old, has been appearing before the court for the past 18 years.
As per its previous order, Rabeya appeared before the High Court today but she needs not to appear anymore.
The court, however, asked for submitting her national identity card before it.
The case was filed on June 2, 2002 against three people, including Rabeya, on charge of possessing illegal arms and bullets.
