The writ also asked for directives employing election officers of the concerned districts instead of recruiting Divisional Commissioners and DC’s for free, fair and transparent election scheduled to be held on December 30.
Abdur Rahman, a lawyer of the Supreme Court, submitted the petition to the concerned division after taking permission from the High Court bench of Justice Syed Refat Ahmed and Justice Md Iqbal Kabir.
However, the petition does not seek postponing the 11th national election.
The writ petitioner claimed conducting election goes against the constitution as article 126 of the constitution enunciated that all executive authorities are entitled to help election commission performing its duties.
As they (DCs) act under the Public Administration Ministry, they can work as anciliary forces if they take part in conducting election.
Hearing on the petition is likely to be held on Monday, added the petitioner.
