Women and Children Repression Prevention Tribunal-1 Judge Md Mansur Alam ordered OC SM Masud Parvez to appear before it in person within seven days and explain his stance.
The court exonerated Sajal Mia, 34, who has been languishing in jail for the two months and ordered his release, said his lawyer Mohan Kumar Saha.
Mohan filed an appeal with the tribunal on May 26 seeking Sajal’s release when the court set June 11 for hearing it in presence of Sajal.
As per the case statement, Selim alias Fazal was sentenced to life imprisonment in 2009 in a case filed under the Women and Children Repression Prevention Act in 2001. He has been on the run since the verdict was pronounced.
On information that Selim would visit his house at Chhotobangram Paschimpara in the city, police conducted a drive there on April 30 and picked up Sajal as Selim. Police continued to claim that they arrested the right person.
Meanwhile, Sajal's lawyer submitted photocopies of the national identity cards of Sajal and his siblings, attested by the local ward councillor, their land documents, Selim’s picture and other necessary papers in this regard.
OC Masud Parvez said witnesses of the case identified the convict and they also submitted affidavits in this regard.
Earlier, Jaha Alam, an innocent man who languished in jail since February 2016 in 26 corruption cases in place of the real accused Abu Salek, was released from jail on February 4 last following a High Court order.
