Fakhrul, Abbas get permanent bail in Nayapaltan clash case
The High Court (HC) on Wednesday granted permanent bail to BNP leaders Mirza Fakhrul Islam Alamgir and Mirza Abbas in a case over the clash between police and the party activists at Nayapaltan on December 7 last year that left one dead.
An HC bench of Justice Md Selim Azad and Justice Md Riaz Uddin Khan passed the order after hearing a rule in this regard.
Advocates Jainul Abedin and Sagir Hossain stood for the BNP leaders while Additional Attorney General SM Munir and Deputy Attorney General SM Golam Mostafa represented the state.
Terming the rule as absolute, the HC granted permanent bail to them, said counsel Sagir.
On the other hand, state counsel Munir said they would take a decision on appeal against the HC order after discussion.
On December 9 last year, a team of Detective Branch (DB) of police picked up Fakhrul and Abbas from their homes in separate raids in the capital.
Later, they were shown arrested in a case over the clash between police and the party activists in the capital’s Nayapaltan. A Dhaka court sent them to jail rejecting their bail pleas.
On January 3, the High Court granted six months bail to BNP Secretary General Mirza Fakhrul Islam Alamgir and Standing Committee member Mirza Abbas in the case.

On the following day, the government filed a petition with the Appellate Division of the Supreme Court seeking stay on the High Court order granting bail to the BNP leaders in the case.
On January 8, A four-member bench of the Appellate Division led by Chief Justice Hasan Foyez Siddiqui upheld the High Court order granting bail to the BNP leaders.
Just after a month of their arrest, Fakhrul and Abbas were freed from jail on bail on January 9 evening.
SC upholds bail of Fakhrul and Abbas, no bar to release
The Appellate Division this morning (January 08, 2023) upheld the High Court order granting bail to BNP leaders Mirza Fakhrul Islam Alamgir and Mirza Abbas in a case filed over the clash between police and the party activists at Nayapaltan on December 7 last year.
A four-member bench of the Appellate Division led by Chief Justice Hasan Foyez Siddiqui passed the order disposing of the state’s petition challenging the HC order.
The court also ordered to dispose of the High Court rule on a maintenance ground.

On January 4, Chamber Judge of the Appellate Division Justice Jahangir Hossain fixed today (Sunday) for the hearing of the petition at the full-bench of the Appellate Division.
The petition was filed on the same day with the Appellate Division of the Supreme Court seeking stay on the High Court order granting bail to the two BNP leaders in the case.
The High Court granted six months' bail to Mirza Fakhrul and Mirza Abbas, in the case on January 3.
The HC also issued a rule asking the government to explain why the two BNP leaders should not be granted permanent bail.

On December 21 last year, Dhaka Metropolitan Session Judge Asaduzzaman rejected the BNP leaders’ bail petitions for the fourth time.

Nayapaltan clash: Fakhrul, Abbas get 6-month HC bail
The High Court on Tuesday (January 03, 2023) granted six months bail to BNP Secretary General Mirza Fakhrul Islam Alamgir and Standing Committee member Mirza Abbas, in a case over the clash between police and the party activists in the capital’s Nayapaltan on December 7 last year.
The HC bench of Justice Md Selim and Justice Md Riaz Uddin granted the bail.
The court also issued a rule asking the government to explain as to why the two BNP leaders should not be granted permanent bail.
Advocate Joynul Abedin stood for the BNP leaders while Additional Attorney General SM Munir represented the state.

Earlier, on Monday, the High Court fixed Tuesday for hearing the bail petitions of the BNP leaders.
Lawyer Sagir Hossain Leone filed separate petitions seeking bail for them.
On December 21, Dhaka Metropolitan Session Judge Asaduzzaman rejected the BNP leaders’ bail petitions for the fourth time.

On December 12, a Dhaka court rejected the bail petitions of 224 leaders and activists of BNP, including Fakhrul and Abbas.
On December 15, the bail petitions of the two BNP leaders were rejected again.

They were accused of instigating, planning and directing an attack on police.
On December 7, a Swechchasebak Dal leader was killed and around 50 others were injured in a clash between police and the BNP activists in front of the party’s Nayapaltan central office, ahead of its December 10 rally.
Police filed four cases at Ramna, Shahjahanpur, Motijheel and Paltan police stations against 720 BNP activists and over 2400 unnamed people in connection with the clash with BNP.
Of the BNP men, 450 were accused in the case filed at Nayapaltan police station, 20 in Motijheel police station case and seven in Shahjahanpur police station case.

ACC submits chargesheet against BNP leader Mirza Abbas, wife
The Anti-Corruption Commission (ACC) on Tuesday submitted a charge sheet against BNP standing committee member Mirza Abbas and his wife Afroza Abbas in a case filed for acquiring wealth illegally.
ACC Secretary Mahbub Hossain disclosed this at a press briefing at the ACC headquarters.

The case was filed with Shahjahanpur (DMP) police station on January 7, 2019.
According to the case, the couple acquired wealth worth around Tk 20.75 crore beyond their known source of their income.
Nayapaltan clash: Fakhrul, Mirza Abbas denied bail again
A Dhaka court on Thursday rejected the bail petition of BNP Secretary General Mirza Fakhrul Islam Alamgir and Standing Committee member Mirza Abbas, in a case over the clash between police and the party activists in the capital’s Nayapaltan.
Dhaka Additional Chief Metropolitan Magistrate Tofazzal Hossain rejected the bail petition after the hearing.
This is the third time the top leaders of BNP have been denied bail in this case.

Senior lawyers Zainul Abedin and Masud Ahmed Talukder appeared for the bail plea while Dhaka Metropolitan Public Prosecutor Abdullah Abu Jamin represented the state.
On Wednesday, the counsel of Mirza Fakhrul and Abbas pleaded for their bail in the court of Dhaka Chief Metropolitan Magistrate Rezaul Karim Chowdhury.
On Tuesday, Mirza Fakhrul’s wife Rahat Ara Begum, Mirza Abbas’ wife Afroza Abbas and advocate AJ Mohammad Ali submitted the petition.

Mirza Fakhrul, Abbas should’ve given division in jail earlier: HC
BNP Secretary General Mirza Fakhrul Islam Alamgir and Standing Committee member Mirza Abbas should have been given the first class facility in jail earlier, said the High Court on Wednesday.
The HC bench of Justice KM Kamrul Kader and Justice Mohammad Ali said this after dismissing the writ petition seeking first class facility in jail for the BNP leaders.
The Magistrate Court ordered to give division facility to them on December 9. But, Mirza Fakhrul and Mirza Abbas could not avail the facility for a few days as the facility was given on Tuesday, said the bench.

Writ petition seeking division in jail filed to HC for Mirza Fakhrul, Abbas
A writ petition seeking first class facility in jail for BNP Secretary General Mirza Fakhrul Islam Alamgir and Standing Committee member Mirza Abbas was filed Tuesday with the High Court.
The petition was submitted to the bench of Justice KM Kamrul Kader and Justice Mohammad Ali.
Mirza Fakhrul’s wife Rahat Ara Begum, Mirza Abbas’ wife Afroza Abbas and advocate AJ Mohammad Ali submitted the petition.
Raising the petition for hearing on Tuesday advocate Ali said “This is a very urgent matter. Two former ministers have not been given division in jail.”

A Dhaka court on Monday rejected the bail petition of 224 leaders and activists of BNP, including Secretary General Mirza Fakhrul Islam Alamgir and Standing Committee member Mirza Abbas, in a case over the clash between police and the party activists in the capital’s Nayapaltan.
Dhaka Metropolitan Magistrate Shafiuddin passed the order when their counsel sought bail for them.
Earlier, on Sunday a court set Monday for hearing of the bail petitions of the BNP leaders and activists in the case.

Mirza Fakhrul, Abbas shown arrested in Paltan police station case: DB Chief
BNP Secretary General Mirza Fakhrul Islam Alamgir and Standing Committee member Mirza Abbas have been shown arrested in a case filed with Paltan police station over Wednesday’s clash that left one dead and several injured.
“They have been arrested in the case filed under the Explosive Substance Act at Paltan police station on Thursday after questioning,” said Harun Or Rashid Chief of Detective Branch of Dhaka Metropolitan Police at a press briefing in the capital Friday.

When asked whether any other central BNP leader is under surveillance he said,” If anyone else is involved with such crimes we will take action against them too. We are keeping an eye on everything.”

Mirza Fakhrul, Mirza Abbas picked up by detectives: BNP
BNP in the early hours on Friday claimed that plainclothes police picked up its Secretary General Mirza Fakhrul Islam Alamgir and Standing Committee member Mirza Abbas from their homes in separate raids in the capital city.
BNP’s Media Cell member Sayrul Kabir Khan said that a team of Detective Branch (DB) of Police went to Fakhrul’s Uttara house at the dead of night and picked him up around 3:00 am.
He said another team of the DB police raided the house of Abbas at the same time and picked him up from his Shahjahanpur home in Dhaka.
Meanwhile, BNP standing committee member Khandaker Mosharraf Hossain condemned the detention of the two top party leaders and said it has once again exposed the government’s political vengeance.
Talking to UNB, he said their party’s decision about Saturday’s rally will be announced after a virtual meeting of the standing committee that was supposed to begin at 11:30am.
Talking to reporters on Friday morning, Fakhrul’s wife Rahat Ara Begum said four DB police members came upstairs of their house around 3am while som others were staying downstairs.
“I asked them the reason behind their arrival here at the dead of night. They said they came here to take him (Fakhrul) away as per the directives of the higher authorities,” she said.
Rahat Ara said as she asked them whether they had any Al warrant for his arrest, the law enforcers said he was accused in two or three fresh cases that were filed yesterday.
She said Fakhrul’s physical condition was not good and he took some medicines with him while he was picked up by the DB police.

“I was asleep when Abbas woke me up and said they (DB members) were going to take me with them and I couldn’t believe it at first,” said Mirza Abbas’s wife Afroza Abbas
They said they will return him after discussion ld with him, she said.
Afroza, also the president of Jatiyatabadi Mohila Dal, said Abbs returned home late night along with some BNP leaders after visiting two possible venues for their party’s Saturday’s rally.
As the BNP leaders, including Barkatullah Bulu, AZM Zahid Hossain and others who had a meeting with the DMP commissioner at night left Abbas’ house around 3am, Afroza said the DB members came to pick up her husband.

While an understanding was reached apparently between the government and the BNP over the rally following the BNP leaders’ meeting with the DMP authorities, taking away of two top leaders of the party has manifested the government’s tough stance against BNP, which is desperate to reinforce its anti-government movement ahead of next general elections.
Home Minister Asaduzzaman Khan has warned of tough action against any anarchy in the name of anti-government movement.
Talking to UNB, some BNP leaders expressed their fear that the government may arrest more senior party leaders to halt the planned rally on Saturday.
