A bench of Justice FRM Nazmul Ahasan and Justice KM Kamrul Kader passed the order after hearing a writ petition filed by Emdadul Haque.
The court also directed to scrap the previous viva examination from the record, and holding a fresh one for recruiting a lecturer in the department.
Barrister Jyotirmoy Barua stood for the writ petitioner while Deputy Attorney General Abdullah Al Mahmud represented the state.
Jyotirmoy Barua said Emdadul Haque had gone to CU for his viva examination on March 27, when a group of students physically assaulted and abducted him for some hours, that coincided with the duration of the viva. Then they beat him up further before branding him a Shibir man and handing him to police.
The circumstances of the attack carried a strong suggestion that it was designed to prevent him appearing for the viva, and thereby to gut his candidacy, as his stellar academic credentials – he had graduated at the top of his class at both Honour’s and Master’s level, from the very same department (Zoology at CU) he was applying to now for a job- made Emdadul a virtual shoo-in to land the position.
On March 30, Emdadul wrote to the Vice-Chancellor of CU relaying his ordeal and requesting a fresh viva towards recruitment of a lecturer for the Zoology department, but the university authorities never replied, he said.
In comments to the media, the university authorities had previously suggested reorganising any stage of the recruitment process was out of the question. Emdad, according to them, would have to wait till another vacancy came up to apply once again.
The court also expressed its aggravation over the deteriorating atmosphere in educational institutes.
