The High Court on Monday summoned Rapid Action Battalion (Rab) Executive Magistrate Md Sarowar Alam for not providing a certified copy of the judgment order of the mobile court.
The magistrate has to appear before the court on December 1.
The High Court bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman issued the order and a rule after hearing a writ petition filed by a mobile court convict.
The court asked why Rab’s inaction over providing the certified copy of the order in a case filed on July 18 should not be declared illegal and why no directive should be given to submit the certified copy within five working days.
The writ petitioner, Md Mizan Mia, manager of a cattle feed producing factory at Siddhirganj in Narayanganj was sentenced to one year imprisonment on July 18 under the Fish Feed and Animal Feed Act 2010.
Mizan, who is now in jail, applied to the mobile court on July 21 for the certified copy of the order but he is yet to receive the copy.
Barrister M Shakhawat Hossain Khan stood for the writ petitioner while Deputy Attorney General Tushar Kanti Roy represented the state.
Law secretary, home secretary, deputy commissioner of Narayanganj, district magistrate, additional district magistrate, director general of Rab and Executive Magistrate Sarowar were asked to respond to the rule within seven days.
