The High Court on Sunday issued a rule asking the government to explain as to why former Chief Justice ABM Khairul Haque should not be granted bail in five cases including Jubo Dal activist Abdul Kaiyum Ahad murder case.
The HC bench of Justice ASM Abdul Mobin and Justice Md Sagir Hossain issued the rule after hearing a petition filed by the former Chief Justice.
Senior Advocate Mansurul Haque Chowdhury stood for the former CJ while Attorney General Md Khairuzzaman represented the state.
Barrister M Sarwar Hossain also represented the Anti-Corruption Commission (ACC).
The HC also made ACC and state counsel respondents to the rule.
Earlier on July 24, police arrested former CJ Khairul Haque from his Dhanmondi residence. Later he was shown arrested in the Jubo Dal activist Abdul Kaiyum Ahad killing case.
He was later shown arrested in another case filed in Narayanganj. Besides, Zahidul Islam Shahin, a Supreme Court lawyer, filed another case with Shahbagh Police Station against him on August 27.
Meanwhile, two more cases were filed against him.
On October 20, separate petitions were filed with the court seeking bail for the former CJ.
On September 30, 2010, Khairul Haque took oath as the 19th Chief Justice of the country and retired on May 17, 2011.
During the last days of the Awami League government, Khairul Haque was the chairman of the Law Commission.
Following the fall of Awami League government he resigned from the Law Commission on August 13.
