Republicans in Montana bar transgender lawmaker from House floor
Montana Republicans barred transgender lawmaker Zooey Zephyr from the House floor on Wednesday, wielding “decorum” rules after she rebuked colleagues supporting a ban on gender-affirming care for children and protested their efforts to silence her.
The punishment marks the first time in nearly half a century that Montana lawmakers have sought such disciplinary action against one of their own. It caps a weeklong standoff between Zephyr and House Republican leaders and formalizes their decision to silence her for saying that those voting in favor of the ban would have blood on their hands.
Zephyr will still be able to vote and participate in committees, but not discuss proposals and amendments under consideration in the full House. The legislative session is set to end in early May.
The fight over Zephyr’s remarks has brought the nationwide debate over protest’s role in democracy to Montana, where lawmakers punished her for voicing dissent, an increasingly prevalent move in statehouses.

Supporting Zephyr’s attempts to regain her voice, protesters interrupted proceedings earlier this week by chanting “Let her Speak” in a boisterous rally that came after they protested outside the Capitol and unfurled a banner that read “Democracy Dies Here.”
After days of rebuffing Zephyr’s request to speak, Republican leaders finally granted her the floor to give a statement before they ultimately voted to discipline her Wednesday. She said her initial “blood on your hands” remark and subsequent decision to thrust a microphone into the air toward protesters in the House gallery were an effort to stand up for the LGBTQ+ community and her constituents in Missoula.
House Speaker Matt Regier’s decision to turn off her microphone, she said, was an attempt to drive “a nail in the coffin of democracy.”
“If you use decorum to silence people who hold you accountable, then all you’re doing is using decorum as a tool of oppression,” Zephyr told her colleagues.
House Republicans who supported barring Zephyr from the floor have accused her of placing lawmakers and staff at risk of harm for disrupting House proceedings and inciting protests in the chamber on Monday.
But lawmakers were on the floor Monday when protesters were in the gallery, and there have been no reports of damage to the building.
“Freedom in this body involves obedience to all the rules of this body, including the rules of decorum,” House Majority Leader Sue Vinton said.
Authorities arrested seven people in the confrontation, who Zephyr said were defending democracy. Her opponents said ensuring government can conduct business on behalf of the people without interruption was a critical precedent to set.
“This is an assault on our representative democracy, spirited debate, and the free expression of ideas cannot flourish in an atmosphere of turmoil and incivility,” Republican David Bedey said on the House floor.
The episode comes weeks after two Black lawmakers, Tennessee state Reps. Justin Jones and Justin Pearson, were expelled for participating in a protest in favor of gun control after another school shooting. Similarly, Zephyr’s punishment has ignited a firestorm of debate about governance and who has a voice in an elected body during this politically polarizing time.
Post-expulsion, the fate of the two Tennessee lawmakers were sent to their county commissions, which swiftly voted to reinstate them. Zephyr told The Associated Press after the vote that Republican leaders were likely aware that a similar sequence of events could be triggered, had they expelled her.
“My community and the Democratic Party in Missoula would send me back here in a heartbeat because I represent them and I represent their values by standing up for democracy,” she said.
In Missoula, the county Democratic Party Chair Andy Nelson said Zephyr’s constituents and supporters were disheartened to see her disciplined.
“What it comes down to is the silencing of not just Rep. Zephyr, but the 11,000 people she serves,” he said after the decision.
The punishment comes two days after protesters later packed into the gallery at the Statehouse and brought House proceedings to a halt chanting “Let her speak” as Zephyr lifted her microphone toward them. Seven subsequent arrests galvanized both her supporters and those saying Zephyr’s actions constitute an unacceptable attack on civil discourse.
The far-right Montana Freedom Caucus, which had pushed for Zephyr to be censured, said in a statement that her actions in support of the protesters were “nothing more than an ego trip.” The caucus again on Wednesday deliberately misgendered Zephyr by using incorrect pronouns when referring to her.
“There needs to be some consequences for what he has been doing,” said Rep. Joe Read, a member of the caucus who frequently and inconsistently used incorrect pronouns for Zephyr.
He claimed Zephyr gave a signal to her supporters just before Monday’s session was disrupted. He declined to say what that was other than a “strange movement.”
“When she gave the signal for protesters to go into action, I would say that’s when decorum was incredibly broken,” Read added.
Zephyr told the AP that she felt the moment was calling on her to stand up for democracy.
“Every time that one of these votes came; every time the speaker refused to allow me to speak; when the protesters came and demanded, my thought was twofold,” she said. “Pride in those who stood up to defend democracy and a hope that in some small way, I could rise to that moment individually and do the work they sent me to do.”

At least 6 dead in highway pileup in U.S. Montana
At least six people died after a dust storm caused a 21-car-pileup on a highway in the U.S. State of Montana Friday evening, said authorities.
Six people are confirmed dead and eight people were transported to nearby hospitals after the pileup, which is described as one of the most intense multi-vehicle accidents in Montana, a local television station reported on Saturday morning.
"My prayers are with everyone affected by the tragic events during the dust storm in Big Horn County today," Montana Attorney General Austin Knudsen wrote on his Facebook page on Friday night.

The Montana Highway Patrol is on the scene with other first responders, said Knudsen, adding that more information will be released when it becomes available.
The numbers of fatalities and injuries did not change overnight and the accident scene has been totally cleared, Montana Highway Patrol Sgt. Jay Nelson was quoted as saying.
Information so far showed the wind storm was an isolated, extreme weather event, Nelson added, noting authorities believed that there is no further danger to the public. ■

Investigators probe deadly Amtrak derailment in Montana
A team of investigators from the National Transportation Safety Board was at the site of an Amtrak derailment in north-central Montana that killed three people and left seven hospitalized Sunday, officials said.
The westbound Empire Builder was en route from Chicago to Seattle when it left the tracks about 4 p.m. Saturday near Joplin, a town of about 200.
Trevor Fossen was first on the scene. The Joplin resident was on a dirt road nearing the tracks Saturday when he saw “a wall of dust” about 300 feet high.
“I started looking at that, wondering what it was and then I saw the train had tipped over and derailed,” said Fossen, who called 911 and started trying to get people out. He called his brother to bring ladders for people who couldn’t get down after exiting through the windows of cars resting on their sides.
The train was carrying about 141 passengers and 16 crew members and had two locomotives and 10 cars, eight of which derailed, Amtrak spokesman Jason Abrams said.
A 14-member team including investigators and specialists in railroad signals would look into the cause of the derailment on a BNSF Railway main track that involved no other trains or equipment, said NTSB spokesman Eric Weiss.

Law enforcement said the officials from the NTSB, Amtrak and BNSF had arrived at the accident scene just west of Joplin, where the tracks cut through vast, golden brown wheat fields that were recently harvested. Several large cranes were brought to the tracks that run roughly parallel to U.S. Highway 2, along with a truckload of gravel and new railroad ties.
Several rail cars could still be seen on their sides.
The accident scene is about 150 miles (241 kilometers) northeast of Helena and about 30 miles (48 kilometers) from the Canadian border.
Amtrak CEO Bill Flynn expressed condolences to those who lost loved ones and said the company is working with the NTSB, Federal Railroad Administration and local law enforcement, sharing their “sense of urgency” to determine what happened.
“The NTSB will identify the cause or causes of this accident, and Amtrak commits to taking appropriate actions to prevent a similar accident in the future,” Flynn said in the statement.
Montana Gov. Greg Gianforte said BNSF was readying replacement track for when the NTSB gives the go-head. “BNSF has assured me they can get the line up and running in short order,” he said.
Railroad safety expert David Clarke, director of the Center for Transportation Research at the University of Tennessee, said accident scene photos show the derailment occurred at or near a switch, which is where the railway goes from a single track to a double track.
Clarke said the two locomotives and two cars at the front of the train reached the split and continued on the main track, but the remaining eight cars derailed. He said it was unclear if some of the last cars moved onto the second track.
“Did the switch play some role? It might have been that the front of the train hit the switch and it started fish-tailing and that flipped the back part of the train,” Clarke said.
Another possibility was a defect in the rail, Clarke said, noting that regular testing doesn’t always catch such problems. He said speed was not a likely factor because trains on that line have systems that prevent excessive speeds and collisions.

Matt Jones, a BNSF Railway spokesman said at a news conference that the track where the accident occurred was last inspected Thursday.
Because of the derailment, Sunday’s westbound Empire Builder from Chicago will terminate in St. Paul, Minnesota, and the eastbound train will originate in Minnesota.
Most of those on the train were treated and released for their injuries, but five who were more seriously hurt remained at the Benefis Health System hospital in Great Falls, Montana, said Sarah Robbin, Liberty County emergency services coordinator. Two were in the intensive care unit, a hospital spokeswoman said.
Another two people were at Logan Health, a hospital in Kalispell, Montana, spokeswoman Melody Sharpton said.
Robbin said emergency crews struggled without success to cut open cars with special tools, “so they did have to manually carry out many of the passengers that could not walk.”
Liberty County Sheriff Nick Erickson said the names of the dead would not be released until relatives are notified.
Robbin said nearby residents rushed to offer help when the derailment occurred.
“We are so fortunate to live where we do, where neighbors help neighbors,” she said.
“The locals have been so amazing and accommodating,” passenger Jacob Cordeiro said on Twitter. “They provided us with food, drinks, and wonderful hospitality. Nothing like it when the best comes together after a tragedy.”
Cordeiro, who is from Rhode Island, just graduated from college and was traveling with his father to Seattle to celebrate.

“I was in one of the front cars and we got badly jostled, thrown from one side of the train to the other,” he told MSNBC. He said the car left the tracks, but did not fall over.
“I’m a pretty big guy and it picked me up from my chair and threw me into one wall and then threw me into the other wall,” Cordeiro said.
Chester Councilwoman Rachel Ghekiere said she and others helped about 50 to 60 passengers who were brought to a school..”
A grocery store in Chester, about 5 miles (8 kilometers) from the derailment, and a nearby religious community provided food, she said.
Allan Zarembski, director of the University of Delaware’s Railway Engineering and Safety Program, said he didn’t want to speculate but suspected the derailment stemmed from an issue with the train track, equipment, or both.
Railways have “virtually eliminated” major derailments by human error after the implementation of positive train control nationwide, Zarembski said. He said NTSB findings could take months.
Bob Chipkevich, who oversaw railroad crash investigations for several years at the NTSB, said the agency won’t rule out human error or any other potential causes for now.
“There are still human performance issues examined by NTSB to be sure that people doing the work are qualified and rested and doing it properly,” Chipkevich said.
Chipkevich said track conditions have historically been a significant cause of train accidents and noted most of the track Amtrak uses is owned by freight railroads and must depend on those companies for safety maintenance.

Sheriff’s office: At least 3 killed in Amtrak derailment
At least three people were killed Saturday afternoon when an Amtrak train that runs between Seattle and Chicago derailed in north-central Montana, an official with the Liberty County Sheriff’s Office said.
Dispatcher Starr Tyler told The Associated Press that three people died in the derailment. She did not have more details. Amtrak said in a statement that there were multiple injuries.
The Empire Builder train derailed about 4 p.m. near Joplin, a town of about 200, Amtrak spokesman Jason Abrams said in a statement. The accident scene is about 150 miles (241 kilometers) north of Helena and about 30 miles (48 kilometers) from the border with Canada.
The train had about 146 passengers and 16 crew members onboard, Abrams said.

The train consisted of two locomotives and 10 cars, with seven of those cars derailing, he said.
Megan Vandervest, a passenger on the train who was going to visit a friend in Seattle, told The New York Times that she was awakened by the derailment.
“My first thought was that we were derailing because, to be honest, I have anxiety and I had heard stories about trains derailing,” said Vandervest, who is from Minneapolis. “My second thought was that’s crazy. We wouldn’t be derailing. Like, that doesn’t happen.”
She told the Times that the car behind hers was tilted over, the one behind that was entirely tipped over, and the three cars behind that “had completely fallen off the tracks and were detached from the train.”
Speaking from the Liberty County Senior Center, where passengers were being taken, Vandervest said it felt like “extreme turbulence on a plane.”

Amtrak was working with the local authorities to transport injured passengers and safely evacuate all other passengers, Abrams added.
The National Transportation Safety Board will send a 14-member team, including investigators and specialists in railroad signals and other disciplines, to investigate the crash, spokesman Eric Weiss said.
Five Amtrak cars derailed around 3:55 p.m. Mountain Daylight Time and no other trains or equipment were involved, Weiss said. The train was traveling on a BNSF Railroad main track at the time, he said.
Photos posted to social media showed several cars on their sides. Passengers were standing alongside the tracks, some carrying luggage.
The images showed sunny skies, and it appeared the accident occurred along a straight section of tracks.
Amtrak said that because of the derailment, the Sunday westbound Empire Builder will terminate in Minneapolis, and the Sunday eastbound Empire Builder train will originate in Minneapolis.

Other recent Amtrak derailments include:
— April 3, 2016: Two maintenance workers were struck and killed by an Amtrak train going more than 100 mph in Chester, Pennsylvania. The lead engine of the train derailed.
— March 14, 2016: An Amtrak train traveling from Los Angeles to Chicago derailed in southwest Kansas, sending five cars off the tracks and injuring at least 32 people. Investigators concluded that a cattle feed delivery truck hit the track and shifted it at least a foot before the derailment.
— Oct. 5, 2015: A passenger train headed from Vermont to Washington, D.C., derailed when it hit rocks that had fallen onto the track from a ledge. The locomotive and a passenger car spilled down an embankment, derailing three other cars and injuring seven people.
— May 12, 2015: Amtrak Train 188 was traveling at twice the 50 mph speed limit as it entered a sharp curve in Philadelphia and derailed. Eight people were killed and more than 200 were injured when the locomotive and four of the train’s seven passenger cars jumped the tracks. Several cars overturned and ripped apart.

Wildfire bears down on Montana towns as West burns
A wildfire bore down on rural southeastern Montana towns Thursday as continuing hot, dry weather throughout the West drove flames through more than a dozen states.
Several thousand people remained under evacuation orders as the Richard Spring Fire advanced across the sparsely-populated Northern Cheyenne Indian Reservation.
Meanwhile, the Dixie Fire — which started July 13 and is the largest wildfire burning in the nation — threatened a dozen small communities in the northern Sierra Nevada even though its southern end was mostly corralled by fire lines.

The blaze had burned over 780 square miles (over 2,000 square kilometers), destroyed some 550 homes and nearly obliterated the town of Greenville. It was 30% contained.
On Wednesday, the Montana fire displayed extreme behavior and had grown by tens of thousands of acres, according to the National Interagency Fire Center. The blaze, which was only 15% surrounded, began Sunday and powerful gusts caused it to explode across more than 230 square miles (600 square kilometers).
By nightfall, the fire had crept within about 2 miles (3.22 kilometers) of the evacuated town of Lame Deer, leaping over a highway where officials had hoped to stop it.
Rancher Jimmy Peppers sat on his horse east of town, watching an orange glow grow near the site of his house.
“I didn’t think it would cross the highway so I didn’t even move my farm equipment,” said Peppers, who spent the afternoon herding his cattle onto a neighbor’s pasture closer to town. “I don’t know if I’ll have a house in the morning.”
The town of about 2,000 people is home to the tribal headquarters and several subdivisions and is surrounded by rugged, forested terrain. By late Wednesday a second fire was closing in on Lame Deer from the west, while the Richard Spring fire raged to the east.

A few miles from town, Krystal Two Bulls and some friends stuck around to clear brush from her yard in hopes of protecting it from the flames. Thick plumes of smoke rose from behind a tree-covered ridgeline just above the house.
“We’re packed and we’re loaded so if we have to go, we will,” Two Bull said. “I’m not fearful; I’m prepared. Here you don’t just run from fire or abandon your house.”
Also ordered to leave were about 600 people in and around Ashland, a small town just outside the reservation. Local, state and federal firefighters were joined by ranchers using their own heavy equipment to carve out fire lines around houses.
The National Weather Service said a ridge of high pressure moving into the area would pump temperatures into the 90s over the weekend.
Drought conditions have left trees, grass and brush bone-dry throughout many Western states, leaving them ripe for ignition. Montana alone had 25 large wildfires burning, according to the National Interagency Fire Center.
At the same time, California and some other states were facing flows of monsoonal moisture that were too high to bring real rain but could create thunderstorms bringing new fire risks from dry lightning and erratic winds.

In Northern California, a number of wildfires and the threat of more prompted three national forests to close down the Trinity Alps Wilderness Area, a half-million-acre area of granite peaks, lakes and trails, into November.
“Tracking hikers in unsafe areas pulls much-needed aircraft away from firefighting efforts, and adds risk and exposure to first responders. Additionally, forest managers hope to limit the possibility of human-caused fires with this temporary full closure,” said a forest statement.
Scientists have said climate change has made the region much warmer and drier in the past 30 years and will continue to make the weather more extreme and wildfires more frequent and destructive. The more than 100 large wildfires in the American West come as parts of Europe are also burning.
