Responding to a petition, an HC bench comprising Justice M Enayetur Rahim and Justice MD Mostafizur Rahman passed the order asking the Judge concerned to respond to the rule within four weeks.
Narail Judge Sheikh Abdul Ahad exempted the prime accused in a murder case and formed complaint against remaining accused on June 10.
One Nazmul Huda filed the case with Kalia Police Station following the murder of his brother named Enamul in front of Chondinagar Government Primary School of the area on February 10, 2015.
A total of 67 people were made accused in the case where Mollik Majharul Islam was the prime accused. But the judge exempted Mollik from the charge.
However, Nazmul Huda filed a petition with the High Court seeking the cancellation of the order of the Narail Judge.
Hearing the petition on Sunday, the HC bench passed the order and fixed July 30 for further hearing, said the plaintiff’s lawyer Mohammad Hossain Lipu.
In the court, Deputy Attorney General Nusrat Jahan represented the state while Mohammad Hossain Lipu and Abdul Alim argued for the plaintiff.
