Justice Md Rezaul Haque and Justice Md Atoar Rahman issued the order after the hearing of an application to dismiss the case. 

Lawyers Rokanuddin Mahumd and Mostafizur Rahman Khan stood for Matiur Rahman while Deputy Attorney General Saifuddin Khaled represented the state.

Mostafizur Rahman said, “We sought cancellation of the case as Matiur Rahman has no connection with the allegation brought against him. He was not even present at the scene. Also, Matiur Rahman was not responsible for the management of the programme.”

On November 12, Dhaka Metropolitan Magistrate Court framed charges against nine people including Prothom Alo Editor Matiur Rahman.

On December 10, the High Court issued a rule seeking an explanation of why the case proceedings should not be cancelled.

Ninth-grader Abrar died after being electrocuted behind the stage at an event organised by Kishor Alo at school campus on November 1.

On November 6, his father Mujibur Rahman filed a case with Dhaka court. The plaintiff alleged that the organisers were negligent in ensuring safety at the venue, which cost the life of his son.

Abrar was taken to Universal Medical College Hospital at Mohakhali although Shaheed Suhrawardy Hospital was close to the venue, Mujibur Rahman said.

Also, he accused Kishor Alo, a publication of Prothom Alo, and the school authority of concealing information about his son’s death and continuing the programme despite the tragic incident.
