The High Court (HC) on Tuesday issued a rule seeking explanation as to why the seat of convicted parliament member Harun-ur Rashid Harun should not be declared vacant.
The bench of Justice Obaidul Hasan and Justice AKM Jahirul Haque issued the rule after hearing a writ petition filed by Chapainawabganj resident Abdul Wadud in the form of a public interest litigation.
Advocate Md Abu Obayed Hossain moved the petitioner while Deputy Attorney General Jesmin Sultana represented the state.
On October 21, Dhaka Special Judges Court-4 sentenced BNP MP Harun, also the lawmaker of Chapainawabganj-4 constituency, to five years in prison and fined him Tk 50 lakh for defying tax.
Obayed Hossain said according to section 66(2)(B) of the Constitution, any lawmaker would be ineligible if he is sentenced for at least two years jail.
