The High Court on Sunday issued a rule asking the government to explain why the 40 percent quota for dependents in Bangladesh Railway's non-cadre recruitment policy ( Grades14th-20th) should not be declared illegal and contradictory to the constitutions.

The HC bench of Justice Mustafa Zaman Islam and Justice SM Masud Hossain Dolon issued the rule after hearing a writ petition.
Railway Secretary, Law Secretary and others were made respondents to the rule, which is returnable in ten days.
Advocate Md Rokonuzzaman stood for the writ petitioner while deputy attorney general Tushar Kanti Roy represented the state.

According to the section 3 (3) of the non-cadre recruitment policy of the Bangladesh Railway, 2020, Railway kept a 40 percent dependent quota for their children which is contradictory to sections 26, 27, 28 and 29 of the constitution, said Advocate Md Rokonuzzaman.
On May 26, a writ petition was filed challenging the legality of the sub clause which said 40 percent quota will be reserved for the dependents for recruiting under 14th to 20th grade of the provision.

According to the writ, following the dependent quota, discrimination will be shown to the children of the day labourers, workers, rickshaw puller and farmers of the country which will deprive them of recruitment in any division under the state.
