The High Court has issued a rule over the death of a Bangladesh Bank official in the capital's Mouchak Market area. The High Court has asked why the failure of the government to keep footpaths safe should not be declared illegal.
The HC bench of Justice Mustafa Zaman Islam and Justice Md Atabullah came up with the rule following a writ petition filed by Supreme Court lawyer Advocate Mosharraf Hossain.

However, the court did not pass any interim order in this regard. The High Court said that a case of unnatural death has been filed and investigation is underway. No interim order will be issued.

Later, locals took her to Sirajul Islam Medical College and Hospital where doctors declared her dead.

HC dismisses writ seeking reschedule of polls
The High Court on Wednesday dismissed a writ petition seeking dissolution of parliament and re-announcement of election schedule for holding it under the direct supervision of the military.
The HC bench of Justice Md Iqbal Kabir and Justice Biswajit Debnath passed the order.
Advocate Saidur Rahman stood for the writ petitioner while Attorney General AM Amin Uddin stood for the state. Assistant Attorney General Md Saiful Alam, MMG Sarwar Payel and Tahmina Poly were also present.
19 BNP supporters sentenced to 2 years in jail in sabotage case
The attorney general said that the writ petition was rejected on the ground of maintainability. The court said the petition did not come properly. They filed the writ directly without sending any notice to the Election Commission.
Earlier, on December 10, a newly registered political party, Insaniyat Biplab Bangladesh, filed the writ petition with the High Court seeking dissolution of parliament and rescheduling of the poll under the direct supervision of the army.
Party chairman Imam Hayat filed the writ petition with the High Court. The writ petition sought directives to appoint the army with magistracy power to maintain law and order during the election.

Secretaries to the Law and Justice Division, Legislative Division, Cabinet Secretary and Chief Election Commissioner were made respondents to the rule.
Speaking to UNB after filing the writ petition, Imam Hayat said, “In the last election, we observed that the ruling MPs misused government power in their respective constituencies and used the administration, police and their own armed men to occupy the polling centres and obstruct others from casting their votes.”

HC asks ACC to let it know progress of probe against Wasa MD
The High Court has asked the Anti-Corruption Commission (ACC) to submit an update on the ongoing investigation against Taqsem A Khan, managing director of Dhaka Water Supply and Sewerage Authority (Wasa) on Tuesday.
Justice Md Nazrul Islam Talukder and Justice Khizir Hayat passed the order on Monday after hearing a writ petition challenging the legality of the Taqsem’s appointment as Wasa MD since 2009.
Advocate Khurshid Alam, ACC lawyer, said that he will inform the court about the progress of the probe on Tuesday.

Barrister Syed Sayedul Haque Suman, a former prosecutor of the International Crimes Tribunal filed the writ petition challenging the legality of Taqsem’s appointment as MD of Wasa alleging flawed process in hiring him.
Seven officials including LGRD secretary, public administration secretary were made respondents to the writ petition.
Barrister Suman said Taqsem has been serving as Wasa MD for the last 13 years since 2009.
During his tenure he has raised the water price to Tk 15 per unit from Tk 6 per unit. He has remained in his post despite allegations of corruption against him, he said.
In 2009 he was appointed after rewriting and rigging his exam result as it was required to have 20 years of experience for that position and he had no such relevant experience, said Suman.

“His appointment letter mentions that the authority is requesting to maintain caution while examining and considering contractual appointments in future. Which means there was some sort of rigging that happened yet his tenure was extended later,” he explained.
The writ petition was filed as his recruitment process needs to be probed, he said.
Taqsem’s tenure as Wasa MD has been extended three times after his 2009 contractual appointment for three years, he said.

HC issues rule on e-scammers Dalalplus
The High Court on Monday issued a rule asking the government to explain why the owners of e-commerce company Dalalplus should not be directed to return Tk 1.39 crore to 41 customers.
Secretaries to the Commerce Ministry, Finance Ministry, Post and Telecommunications Ministry, Chairman of Anti-Corruption Commission, Bangladesh Bank Governor and 16 accused including Dalalplus authorities have been made respondent to the rule which is returnable in four weeks.
The HC bench of Justice Md Mozibur Rahman Miah and Justice Kazi Md Ejarul Haque Akondo passed the order after hearing a writ petition.
Advocate Humayun Kabir Pallab stood for the petitioner while deputy attorney general Arbind Kumar Roy represented the state.
On June 28, Supreme Court lawyer Mohammad Humayun Kabir Pallab filed a writ petition seeking Tk 1.39 crore back to 41 customers of e-commerce company Dalalplus.

The writ petition also sought necessary steps against the irregularities of Dalalplus.
41 customers of Dalalplus including Morshed Noman paid money for purchasing their respective products in May, June and July and still they failed to receive their products.
Later, they filed a writ petition against the e-commerce company.
They are also involved in collecting several crores of money from the customer by publishing advertisements. Without providing products, the company embezzled the money of customers.

Issue red alerts for arrest of 39 fugitives in Destiny scam case: HC
The High Court on Thursday directed the authorities concerned to take necessary steps to bring to justice 39 fugitives convicted in the case filed for embezzling Tk 4,000 crore from Destiny Group subscribers.
The Inspector General of Police (IGP), Anti Corruption Commission (ACC) and law enforcement agencies have also been asked to issue Interpol red notices in order to alert international authorities of the compulsion to arrest the fugitives.
Justice Md Nazrul Islam Talukder and Justice Kazi Md Ejarul Haque Akondo passed the order after rejecting a petition filed by former army chief Lt Gen (retd) Harun-Ar-Rashid seeking bail in a case, said Deputy Attorney General AKM Amin Uddin Manik.

On May 12, a Dhaka court sentenced all 46 accused, including Destiny Group Managing Director Rafiqul Amin and Destiny-2000 president Lt Gen (retd) Harun-Ar-Rashid, to different terms of imprisonment in the money laundering case and fined Tk 2,300 crore.
Among the convicts, Rafiqul Amin, Mohammad Hossain, M Harun-ur-Rashid, Jasmine Akter, Ziaul Haque and Saiful Islam are now in jail.
The 39 fugitives are mostly the lower –ranked officials of the company, but include a deputy managing director and a director.

HC orders providing protective equipment to physicians, nurses
The High Court on Sunday asked the authorities concerned to take immediate steps to collect and supply personal protective equipment (PPE) to the physicians, nurses and others working at different hospitals.
Justice Md Ashraful Kamal and Justice Sardar Md Rashed Jahangir came up with the order following a petition in this regard.
The HC also asked the authorities concerned to form a committee for making a list of PPE, surgical mask, gown, shoe-cover, gloves and hand sanitizers. The committee was asked to provide the list within 48 hours.
The committee will include Health secretary, Director General of the Directorate General of Health Services (DGHS), Director of IEDCR and Director of Central Medical Stores Depot.
The Finance Ministry has been asked to allocate money for procuring the equipment as per the list.
Advocate Ekhlas Uddin Bhuiya and two other lawyers on behalf of the Human Rights and Peace for Bangladesh filed the writ with the High Court seeking order to provide necessary equipment to the physicians , nurses and other concerned at different hospitals.
Advocate Munzill Murshid stodd for the petitioner.
