ACC’s graft case: Recording testimony of ex-OC Pradeep suspended
A Chattogram court on Thursday suspended recording the testimony of Ex-OC Pradeep Kumar Das, a death row convict in Major Sinha (retired)murder case, in a case over acquiring wealth illegally.
Chattogram Divisional Special Court Judge Munshi Abdul Mazid passed the order during a hearing on a petition submitted by Pradeep’s lawyer.
However, the court said recording testimony of Pradeep’s wife Chumki will continue.
Earlier in the day, the court recorded statements of Mohammad Riaz Uddin, plaintiff of the case and Assistant Director of Anti-Corruption Commission (ACC).
Pradeep Kumar Das was taken to the Chattogram court on Thursday amid strict security from Kashimpur Central Jail in Gazipur.
“The court fixed January 17 to record the testimonies but it began today. Pradeep’s lawyer appealed for suspending recording of testimony of Pradeep until the High Court’s hearing on his petition seeking the cancellation of the indictment order in the case which the court granted,” said Mahmudul Haque Mahmud, ACC lawyer.
On January 30, ex-OC Pradeep submitted the petition to the HC seeking cancellation of indictment order and judicial proceedings in this case.
On December 15 last year, a Chattogram court indicted Pradeep in this case.
Earlier on September 1, the court accepted a charge sheet in the graft case against the sacked OC and his wife Chumki.
ACC Chittagong Assistant Director Md Riaz Uddin submitted the charge sheet on July 26.
On August 23 in 2020 ACC filed the case against Pradeep, and his wife for amassing wealth worth Tk 4 crore.
ACC sources said the anti-graft watchdog’s investigation against Pradeep started in 2018.
On April 20 last year, Pradeep and his wife were asked to submit their wealth statement and they submitted their wealth statements in June that year.
After a long investigation, the ACC found evidence that the couple acquired assets worth more than Tk 4 crore illegally.

Sinha murder case: Death references reach HC
The death references of Maj (retd) Sinha Mohammad Rashed Khan murder case reached the High Court on Tuesday.
The death references reached the branch concerned of the High Court, said Mohammad Saifur Rahman, Special Officer of the Supreme Court.
According to the law, if a convict is sentenced to death by a lower court, all the documents of the case are sent to the High Court for approval of the penalty.
When the case ‘Paperbook’-file containing all documents- is prepared the hearing on death references is held as per serial.
On January 31, A Cox’s Bazar court sentenced former OC Pradeep Kumar Das and police inspector Liakat Ali to death and six others to life term imprisonment in the Sinha murder case.
The six lifers are constable Sagar Dev, sub-inspector Nandolal Rakkhit, constable Rubel Sharma, Nurul Amin, Md Nizamuddin and Ayaz Uddin.
The court, however, acquitted seven other accused.

On July 31, 2020, Sinha was shot dead at the Shamlapur police check-post in Baharchhara Union of Cox's Bazar while returning to the town after filming for a documentary.
On August 5, 2020, Sinha's sister, Sharmin Shahriar Ferdous, filed a case with Teknaf Senior Judicial Magistrate Court accusing nine members of law enforcement agencies of being involved in the killing, including former officer-in-charge of Teknaf Model Police Station Pradeep Kumar Das and Baharchhara Police Outpost inspector Liakat Ali.
On December 13, the same year, Rapid Action Battalion (RAB) submitted a charge-sheet against 15 people, including ex-OC Pradeep, police source Ayaz and three APBn members, in the case.
On June 27, 2021, the court framed charges against them.

Expectation fulfilled, says sister after Sinha murder verdict
The sister of Maj (retd) Sinha Mohammad Rashed Khan welcomed Monday’s judgment in the case of his murder as fulfilment of the family’s expectation.
“But we will be satisfied only after the judgment is implemented,” Sharmin Shahria Ferdous, the plaintiff in the case, said in her reaction.
Cox’s Bazar District and Sessions Judge Mohammad Ismail former OC Pradeep Kumar Das and police inspector Liakat Ali to death and six others to life term imprisonment in the case.

The six lifers are constable Sagar Dev, sub-inspector Nandolal Rakkhit, constable Rubel Sharma, and residents of Marishbunia village in Baharchara upazila Nurul Amin, Md Nizamuddin and Ayaz Uddin.
The court, however, acquitted seven other accused.
Maj (retd) Sinha’s mother Nasima Akter was present to hear the judgment in Cox’s Bazar court with daughter Sharmin.
After the pronouncement of the judgement Sharmin told journalists,” We were hoping that the two main accused OC Pradeep and Liakat who were directly involved in the killing will get death sentence which has been fulfilled by this verdict. We will be satisfied finally when it gets implemented.”
“May no one become a victim of extra judicial killing in the country again. Everyone has the right to seek justice and law prevails. It has been proved by this verdict,” she said.
The 15 accused were brought to the court from Cox's Bazar district jail at 2 pm.
Of the 15 accused, 12 had given confessional statements before court except Pradeep, Sagar Dev and Rubel.
Ahead of the delivery of the judgment, security was beefed up in Cox’s Bazar town.
Additional police personnel have been deployed in and around the court premises while a number of check-posts were set up at different points.

Judge’s observation: Active role of OC Pradeep, 2 others proved over killing Sinha
Cox's Bazar District and Sessions Judge Mohammad Ismail on Monday observed that the killing of Maj (retd) Sinha Mohammad Rashed Khan was premeditated.
His observation came before delivering judgment in the sensational murder of the retired major at a police check post in Teknaf on July 31, 2020."I have tried to find out the details of the Major Sinha murder", he said. “Three members of APBN were in charge. The trio first released Sinha's car after stopping it, but the police stopped it again and shot him within 10 to 20 minutes".

The judgment in Maj (retd) Sinha Mohammad Rashed Khan murder case is being read out at a Cox's Bazar court in presence of 15 accused in the case.
The 15 accused were brought to the court from Cox's Bazar district jail at 2 pm on Monday.
District and Sessions Judge Mohammad Ismail started to read out the judgment when the accused were produced before the court, said Public Prosecutor Faridul Alam.

Sinha murder trial: Fifth witness testifies before court on day 3
The third day of second phase of testimonial statements in the murder case of Maj (retd) Sinha Mohammad Rashed Khan concluded at a Cox’s Bazar court Tuesday with the testimony and statement of the fifth witness.
The court adjourned at around 5 pm after Hafeez Mohammad Amin’s testimony as an eyewitness and his interrogation by defense lawyers.
The statement was recorded before Cox’s Bazar district and session court Judge Md Ismail.
He was presented before the court amid tight security around 10 am on the day.
After the hearing, defense lawyer Rana Dasgupta told the media that Mohammad Amin is a Rohingya.
“He said that he saw the murder from atop a mosque and he used to work there. However, the president and the general secretary of the mosque informed us that they don’t know anyone by this name.”
Public Prosecutor Faridul Alam refuted the claim and said that the witness is a Bangladeshi citizen.
He went on to say that the national identity of the witness is irrelevant and the matter is being brought up to steer the conversation to a different direction.
Plaintiff's lawyer Advocate Mohammad Jahangir added that the aforementioned mosque does not have any committee.

“The concept of the president and general secretary not knowing the witness is ludicrous as the mosque doesn't have a committee in the first place,” he added.
Earlier, during the three-day testimonial statements recording from August 23 to August 25, plaintiff Sharmin Sahariya Ferdous, sister of Sinha, and witness Shahedul Islam Sifat’s statements were recorded.
On Sunday, third witness Mohammad Ali’s statement was recorded at the court on the first day of the second phase of testimonial statements.
On Monday the court heard from the fourth witness, CNG driver Kamal Hossain’s testimony .
The 11 other witnesses who received the court notice are scheduled to testify by Wednesday.

Sinha murder: Court warns against 'media trial'
A Cox’s Bazar court has asked all concerned to be careful not to turn the Sinha Murder trial into a 'media trial'.
Judge Ismail Hossain of the Cox's Bazar District and Sessions Court made the observation after completion of recording witness statements Sunday.
Public Prosecutor Faridul Alam and Defendant's lawyer Advocate Rana Das Gupta revealed the court's observation to the press.

They said that the court asked the responsible authorities to avoid talking to the media about the details of the case, stating that it increases the chance of a media trial .
The court on Sunday morning started the second phase of testimonies in a case filed over the murder of Major (retd) Sinha Md Rashed Khan.
The testimony of the third witness named Mohammad Ali was recorded during this time.
According to the case charge sheet, there are 83 witnesses.
The testimony of two others were recorded in the first phase between August 23-25.

They were plaintiff Sharmin Shahriar (Sinha's sister), and eyewitness Shahidul Islam Sifat.
Major (retd) Sinha was killed in police firing at Baharchhara police check-post on July 31.
Sharmin Shahriar filed the case at Teknaf Senior Judicial Magistrate Court, accusing 13 police members.

Sinha murder case: Police source Ayaz denied bail
The High Court has denied bail to Mohammad Ayaz, a police source accused in a case filed over the murder of Major (retd) Sinha Md Rashed Khan in Teknaf last year.
The bench of Justice Krishna Debnath and Justice KM Zahid Sarwar removed the petition from its cause list for Thursday.
Attorney General AM Amin Uddin and Deputy Attorney General Sarwar Hossain Bappi stood for the state while Advocate Amirul Islam represented the accused.

"There are allegations of criminal conspiracy against Ayaz, which he did not mention in his bail application. So the High Court dropped his bail application from its cause list," Sarwar Hossain said.
On December 13, 2020, Rapid Action Battalion (RAB) submitted a charge sheet against 15 people including police source Ayaz and three APBn members in connection with the case filed over Sinha's murder at a checkpost manned by APBn, where officers of the Teknaf police station intercepted Sinha's car.
Khairul Islam, assistant superintendent of police of RAB-15 and also the investigation officer of the case, submitted the charge sheet before Cox's Bazar Senior Judicial Magistrate Tamanna Farah.
