Evaly would refund customers’ money in a short time: CEO Russel
Evaly founder and Chief Executive Officer (CEO) Mohammad Rassel on Tuesday said that his company will not take much time to refund money lost by customers with the way the e-commerce platform is currently being managed.
He expressed this optimism at a discussion on consumer rights in the e-commerce and e-services sector, held at Dhaka Reporters Unity on Tuesday. The meeting was organized by the Bangladesh Mobile Consumers Association (BMCA).
Evaly CEO Rassel: no relief from jail despite bail in DSA case
He said that if everyone cooperates with the way Evaly is currently operating and making profits, it will not take much time to resolve customers’ liabilities.
Evaly’s business is being managed by a cash and delivery system, Russell said, where the customer will pay after receiving the product. The money will go directly to the company that supplies the product. From there, VAT, and taxes are paid to the government.

According to the BMCA, currently, the e-commerce market in the country is around USD $3 billion, with significant growth potential.

Evaly CEO Rassel, Chairman Nasrin indicted in DSA case
A Dhaka court on Thursday indicted controversial e-commerce platform Evaly’s Managing Director (MD) and Chief Executive Officer (CEO) Md Rassel and its Chairman Shamima Nasrin facing charges under the Digital Security Act case.
The decision means the formal trial in the case started on Thursday.
Dhaka Cyber Tribunal Judge AM Zulfiqar Hayat passed the order to frame the charges against the MD and chairman of the Evaly.
The court also set May 2 for recording the testimonies in the case, he said. Rassel was produced before the court with a petition to relieve him from the charges while the court turned down it.
On the other hand, counsels of absconding Nasrin, the wife of Rassel, refrained from the hearing.
Counsel Nazrul Islam Shamim stood for the state while lawyer Ahsan Habib represented the defendants during the hearing in the case.

Defence lawyer said Rassel demanded justice by claiming himself innocent.
On September 16, 2021, Rassel and Nasrin were arrested in a raid on their home in the capital's Mohammadpur area.
The owners of Evaly were allegedly involved in embezzlement of several hundred crores of taka. They were arrested after a victim filed a case against them.
Arif Baker lodged the case with Gulshan police station accusing the couple of stealing customers' money and fraudulence.
The couple was later sent to jail.

Court issues arrest warrant against Evaly chairperson Shamima
A Dhaka court has issued a warrant for the arrest of Shamima Nasrin, the chairperson of e-commerce company Evaly, in a case filed under the Digital Security Act (DSA).
Dhaka Cyber Tribunal judge Mohammad Ash Shams Jaglul Hossain issued the arrest warrant on October 19 turning down Shamima’s time petition as she did not appear before the court.
The court also fixed January 22 next year for hearing on charge framing in the case.
Earlier, the court fixed October 19 for accepting the charge sheet in the case, however, Shamima pleaded for time through a lawyer without appearing in the court, said tribunal bench clerk Shamim Al Mamun.
On September 30 last year, a customer Alamgir Hossain filed the case against Evaly CEO Mohammad Rassel and his wife Shamima at Badda police station, on charges of embezzling money through digital fraud.
According to the case, the plaintiff ordered products costing Tk 28 lakh from Evaly through two accounts on the company site and paid the bill.
Evaly promised him to deliver the products within 45 days of the order. But the customer didn’t receive the products. The company also didn’t return the customer’s money.
On September 16, last year, Evaly CEO Mohammad Rassel and his wife Shamima were arrested during a raid on their house in the capital's Mohammadpur area. The couple was later sent to jail.
On April 6 this year, Shamima came out of jail securing bail. However, the CEO is still behind bars.

Evaly back in business: ‘Thank You’ campaign from Oct 28
Evaly is set to resume operation with a ‘Dhonnobad Utshob’ (‘Thank You Festival’) to express gratitude to millions of customers and merchants across Bangladesh.
The platform will start the campaign from October 28 at 10 pm, said a press release from the company.
Popular brands like Walton, Jamuna, Artisan, O'code, Viomi, Samsung, iPhone, One Plus, and Vivo will participate in the Evaly campaign.

For purchases from the secured platform, customers will have three options: pick and pay, cash on delivery and cash before delivery. Customers will also get a ‘star’ for each shipment from Evaly under the customer loyalty program. The loyalty points can be used for future shopping with the platform.
Regarding the campaign, Evaly co-founder Shamima Nasrin said the company strongly believes that it will be able to repay past debts through resuming operations.
“Evaly is now a brand infused with this nation’s passion. We now have two independent directors from e-CAB and commerce ministry. So now, there’s more responsibility and accountability than before,” she said.

Shamima mentioned that Evaly will offer products at an attractive price, without counting losses. “Utilising the infrastructure of digital Bangladesh and selling products profitably using e-commerce, we can give customers the ‘best price’ compared to the traditional market. We will give utmost importance to quick delivery and customer service,” she added.
The entrepreneur has pledged to deliver all previous orders. “We are looking forward to the early release of our former CEO Mohammad Rassel to accelerate our momentum and strengthen Evaly,” Shamima said.

Evaly files application to restart business
Former chair of ecommerce platform Evaly Shamima Nasrim Wednesday appealed to a board formed by the High Court asking to be allowed to resume their business.
Shamima said they had found investors and wanted to run the company on their own. And she promised to pay back the money Evaly owes its customers and vendors after reviving its business.
The former Evaly chair also sought the court's permission to include herself, her mother and brother-in-law on the board of directors.
For Shamima, Lawyer Ahsanul Karim filed an application to the High Court bench of Justice Muhammad Khurshid Alam Sarkar.

The bench is likely to hold a hearing on the application Sunday, Ahsanul said.
Another application was also filed, seeking directives for not harassing Shamima and Mohammad Rassel, former managing director and chief executive officer of Evaly, by filling a new case, he added.
On September 16 last year, Rapid Action Battalion arrested Rassel and his wife Shamima during a drive at their residence in Dhaka's Mohammadpur in an embezzlement case filed with Gulshan Police.
Six days later, the High Court put a moratorium on the sale or transfer of all movable and immovable properties of Evaly following an application filed by a customer.
On 18 October 2021, the court formed a five-member board to manage, control, and assess the liabilities of the e-commerce platform.
On April 22, Shamima was released on bail from Kashimpur Women's Central Jail in Gazipur.

Evaly CEO, chairman sued again in Chattogram
A case has been filed against e-commerce platform Evaly's Chairman Shamima Nasrin and CEO Mohammad Rassel in Chattogram on charge of embezzlement and fraudulence.
Chowdhury Naeem Sarwar, a businessman of the city's Chawkbazar, filed the case in the court of Chattogram Metropolitan Magistrate Jewel Deb on Tuesday.
The court also summoned the accused after accepting the case, said plaintiff's lawyer Advocate Abul Hasnat.
It was alleged in the case statement that the plaintiff was impressed by the advertisement of Evaly and ordered a motorcycle worth Tk 160,000. But no motorcycle was delivered to him so far. A check was later issued from Evaly's office which was dishonoured later.

On December 15 last year, another businessman from Chattogram filed two cases against Evaly CEO and Chairman in the court of Chattogram Metropolitan Magistrate Saddam Hossain over cheque fraud.
On April 6, Rassel’s wife Shamima Nasrin, Chairperson of Evaly, walked out of Kashimpur Women's Central Jail after the court granted them both bail in another six cases on condition of settling the case with the plaintiffs in different times.

HC allows Evaly’s Rassel, Shamima to transfer 50 % of their shares to relatives
The High Court on Thursday granted permission to former Evaly CEO Md Rassel and its chairman Shamima Nasrin , also his wife, to transfer half of their shares in the troubled company to three of their relatives.
HC bench of Justice Muhammad Khurshid Alam Sarkar passed the order amending the previous order putting bar on asset transfer during a hearing on a petition filed by those three relatives in this regard.
The three relatives are Rassel’s father-in-law, mother-in-law and brother-in-law.
However, three of them will not be allowed to transfer the shares without the High Court’s permission, said the court in its order.

They will be liable to the new Board of Directors of the company formed by HC regarding the shares.
The court directed the Inspector General of Prisons to assist in the transfer process as it will be conducted when both Rassel and Shamima remain behind bars.
The court also asked Evaly office building owner Sheikh Salhuddin to appear before court on February 24.
Otherwise, the court directed police to arrest him and produce before court.
Lawyer Shamim Ahmed Mehedi appeared for Rassel and Shamima’s relatives in the court while lawyer Syed Mahsib Khan, presented the writ petitioner’s side and Taposh Kanti Bal appeared for the Ministry of Commerce.
Lawyer Syed Mahsib said the relatives of the former executives of Evaly appeared before court and said they are working to reform the company.
The court passed the directions after they said they want to take steps to return the products and money to the affected consumers of Evaly and assist the Board in this regard, he said.

On last September 22, the High Court ordered a ban on the sale and transfer of movable and immovable property after an application submitted by an affected customer seeking dissolution of the company and direction on forming a board of directors for the company.
On October 18, the High Court formed a 5-member board, led by former justice Shamsuddin Chowdhury Manik, to manage, control and assess the liabilities of shuttered e-commerce platform Evaly.
Other members of the board are former secretary Mohammad Rezaul Ahsan and additional secretary Mahbub Kabir Milon, chartered accountant Fakhruddin Ahmed and lawyer Barrister Khan Mohammad Shamim Aziz.

Group of Evaly customers, merchants seek Russell's bail to continue business
Leaders of Evaly Merchant and Customers Coordination Committee (EMCCC) have demanded the immediate release from jail of its disgraced CEO Mohammed Russell and his wife Shamima Nasrin, the company's chairman, together with their transfer to the custody of merchants and consumers with conditions.
Nasir Uddin, coordinator of EMCCC and Shakib Hasan, co-coordinator voiced the demand through a press conference at Dhaka Reporters’ Unity (DRU) on Tuesday.
They believe suchg a step would provide the best chance of restarting the business, and so generating funds to repay the company's debts.
Shakib Hasan said, "We want the Prime Minister’s intervention to release Russell for the sake of millions of merchants and consumers and we would be grateful to you (Prime Minister) for your intervention in granting bail to Russell."

Over 20,000 merchants and consumers EMCCC have favoured Russell's bail on social media, he added.
Their signatures have been submitted to the Prime Minister for this. They demand that Russell be released on parole and given a chance to run his business.
They claimed at the press conference that over 7.4 million customers, 35,000 merchants and 5000 employees were directly associated with the business of Evaly, which started business inspired by the government’s Digital Bangladesh dream.
Evaly played a role in creating thousands of young entrepreneurs across the country through its new idea of business. In the absence of Russell many of them fell into risk of losing their business.
Both customers and merchants have fallen in uncertainty, so continuing the business of Evaly will be helpful to recovery of money paid in advance by customers, rather than keeping Russell in jail, they said.

In a written statement at the press conference, Shakib Hasan said, "The merchant consumers of Evali want Shamima Nasrin, the chairman of the company, and Russell, the CEO, to give us a chance to continue our business and repay the loans."

HC orders to audit Evaly's assets by a reputed firm
The High Court on Tuesday directed to audit the assets of the e-commerce company Evaly by a reputed audit firm in the country.
A single HC bench of Justice Muhamad Khurshid Alam Sarkar passed the order following the application submitted by the board of directors of Evaly that was formed on the direction of the court.
Earlier, a court ordered a company named KPMG to audit Evaly's assets on October 18 last year. But the company charged Evaly Tk 86 lakh to conduct the audit. And so, the board directors of Evaly appealed to the court to have company audited by another firm, said Barrister Syed Mahsib Hossain.

Barrister Morshed Ahmed Khan appeared for the board of directors of Evaly in the court while Barrister Syed Mahsib Hossain for the writ petition.
Another petition was also presented in court today. One of the customers appealed seeking to be included in a party in the case for non-receipt of payment for Evaly's product and the court registered his appeal.

HC allows Evaly to withdraw Tk 2.35 cr for operating expenses
The High Court on Sunday allowed its appointed board of directors for disgraced e-commerce company Evaly to withdraw Tk 2.35 crore deposited at City Bank and Southeast Bank for operating expenses.
A single HC bench of Justice Muhamad Khurshid Alam Sarkar passed the order following the application submitted by the board of directors of Evaly, that was formed on the direction of the court.

The court also directed Bangladesh Bank and National Board of Revenue (NBR) to submit details on expenditures logged by Evaly’s former chief executive officer Mohammad Rassel and Chairperson Shamima Nasrin.
At the same time, 22 vehicles registered by Evaly have been allowed to be rented or sold.
Barrister Morshed Ahmed Khan appeared for Evaly board while Barrister Syed Mahsib Hossain for the writ petition.
Barrister Syed Mahsib Hossain said the board of directors of Evaly could not withdraw any money from the bank accounts as Bangladesh Financial Intelligence Unit (BFIU) froze all the accounts of Evaly.
