Mitu Murder: HC dismisses writ challenging charge framing against ex-SP Babul
The High Court on Tuesday (May 09, 2023) dismissed a writ petition filed by former Superintendent of Police Babul Akhter challenging the legality of framing charges against him in the murder case of his wife Mahmuda Khanam Mitu.
The HC bench of Justice SM Kuddus Zaman and Justice Shahid Noor Uddin passed the order.
Now there is no legal bar to continuing the trial proceeding against him in the judicial court.
Deputy Attorney General Sujit Chatterjee Bappi represented the state while Advocate Mohammad Shishir Monir appeared for Babul Akhter.

Earlier on March 13, a Chattogram court framed charges against seven people including Babul Akhter in Mitu murder case. Later, Babul Akhter appealed to the High Court challenging the validity of it.
On June 5, 2016, Mitu was stabbed and shot dead when she was walking her son to his school bus stop at the port city's GEC intersection.
On June 6, 2016, Babul filed a case with Panchlaish Police Station.
On September 13, the Police Bureau of Investigation (PBI) pressed the charges against Babul Akter and six others in a case filed over the killing of his wife Mahmuda Khanam Mitu.

Abu Zafar Md Omar Faruk, inspector of PBI and also the investigation officer of the case, submitted the chargesheet to the prosecution unit of the Chattogram court.
The case was transferred to the Police Bureau Investigation (PBI) in 2019 after Mitu's father, himself a retired police officer, filed a complaint against the CMP's mishandling of the case.
On May 12, 2021, the PBI submitted its final report and arrested Babul Akter in another case filed by Mitu’s father and since then he has been in prison.
Babul Akhter also filed a no-confidence petition against the PBI report on October 14, 2021.

On November 3 last year, a Chattogram Court rejected the final report of PBI in the murder case and ordered it to conduct further investigation.

The Police Bureau of investigation (PBI) on Tuesday pressed charges against former Chattogram Superintendent of Police (SP) Babul Akter and six others in a case filed over the killing of his wife Mahmuda Khanam Mitu.
Abu Zafar Md Omar Faruk, inspector of PBI and also the investigation officer of the case, submitted the chargesheet to the prosecution unit of the Chattogram court.
On June 5, 2016, unidentified assailants gunned down Babul's wife Mitu at the port city's GEC intersection while she was going to drop her son Mahir Akhter, 7, for a bus of Chittagong Cantonment Public School and College.

Soon after the crime, Babul filed a murder case at Panchlaish Police Station against three unidentified men.

Why Babul Akter should not be granted bail: HC
The High Court on Monday issued a rule asking the government to explain why former Chattogram Superintendent of Police (SP) Babul Akter, arrested in a case over the murder of his wife Mahmuda Khanam Mitu in 2016, will not be granted bail.
A divisional bench of Justice AKM Asaduzzaman and Kazi Ejarul Haque Akondo issued the rule after hearing the bail petition of Babul Akter.

The respondents were asked to respond to the rule in the next two weeks.
Senior lawyer Mansurul Haque Chowdhury and lawyer Mohammad Shishir Monir appeared for his bail while Deputy Attorney General Md Aminul Islam and Assistant Attorney General Md Jahangir Alam and Md Humayun Kabir represented the state.
Earlier on January 6, a Chattogram Court denied bail to Babul Akter in the case. He was shown arrested on January 9.

Ex-SP Babul shown arrested in case filed by him
A Chattogram court on Sunday shown former Chattogram Superintendent of Police (SP) Babul Akter arrested in a case filed by him over the murder of his wife Mahmuda Khanam Mitu in 2016.
Chattogram Chief Metropolitan Magistrate Mohammad Abdul Halim accepted a petition filed by Police Bureau of Investigation (PBI) inspector Abu Zafar Mohammad Omar Faruk to show Babul Akter arrested in the case filed with Panchlaish Police Station.

Babul himself filed the case soon after the murder.
On December 30, 2021, the PBI inspector filed the petition seeking its permission to show Babul arrested in the case.
On May 12, 2021, the Police Bureau of Investigation (PBI) arrested Babul Akter in another case filed by Mitu’s father and since then he has been in prison.PBI in an investigation found Babul’s involvement in his wife's murder.
The case was transferred to the Police Bureau Investigation in 2019 after Mitu's father, himself a retired police officer, filed a complaint against the CMP's mishandling of the case.
Mitu's father had, in fact, accused Babul of being directly involved in the murder case.

Of them, Anwar and Wasim gave confessional statements before a magistrate, implicating seven people, including Musa who directly took part in the killing, Mohammad Rashed and Nabi.
During the course of the probe, police had also arrested "arms supplier" Ehteshamul Haque Bhola and his assistant Md Monir and seized a pistol from their possession.

Cops had also arrested Musa's elder brother Saidul Shikder Shakur and Shahjahan for providing the motorbike that was used in the murder. But on July 4, 2016, Nabi and Rashed were killed in a gunfight with police in Rangunia.
Babul was called for questioning a number of times by the PBI since his transfer.

Mitu murder case: Court rejects PBI’s final report
A Chattogram court on Wednesday rejected the final report of Police Bureau of Investigation (PBI) in Mahmuda Khanam Mitu murder case and ordered it to conduct further investigation.
Chattogram Metropolitan Magistrate Begum Mehnaz Rahman passed the order after rejecting the final report of PBI in the case.
The court also rejected the ‘naraji(discontent) petition’ of former police superintendent Babul Akter in the case, said Advocate Iftekhar Saimul Chowdhury.
Babul, who served as SP of Chattagram, has been in Feni District jail since May 17.
On May 12, Babul was taken on a 5-day remand by PBI for interrogation after being arrested in a case filed by his father-in-law over his wife’s killing.

On June 24, 2016 night, he was questioned for 15 hours at the intelligence office in Dhaka and on September 6, he voluntarily resigned from the police service.
On May 11, PBI submitted its report in the murder case. They also found Babul’s involvement in the case.
Later, Babul’s father-in-law filed a fresh case against him on May 12.
Eight people including Babul were accused in the case filed by Mitu's father, Mosharraf Hossain.
The other accused are Kamrul Islam Shikder alias Musa, Ehteshamul Haque Bhola, Motaleb Mia alias Wasim, Anwar Hossain, Khairul Islam alias Kalu, and Shahjahan Mia.

Babul Akhter also filed a ‘naraji petition’ against the PBI report on October 14 and after hearing the petition the court fixed November 3 for next hearing.
On October 23, Ehteshamul Haque Bhola, an accused in ex-police superintendent Babul Akter's wife Mahmuda Khanam Mitu murder case, confessed to supplying firearms used in the killing before a Chattogram court.

Mitu murder: accused Bhola confesses to supplying firearms
Ehteshamul Haque Bhola, an accused in ex-police superintendent Babul Akter's wife Mahmuda Khanam Mitu murder case, has confessed to supplying firearms used in the killing before a Chattogram court.
Chattogram Metropolitan Magistrate Shafi Uddin recorded his confessional statement under section 164 of the Code of Criminal Procedure (CrPC) on Saturday afternoon, said Police Bureau of Investigation (PBI) and Chattogram Superintendent of Police Naima Sultana on Saturday night.
However, SP Naima Sultana did not say anything about what Bhola said in her statement. She said Bhola was sent to jail after recording of his statement.

Santosh Chakma, the investigative officer in the case and PBI Inspector (Chattogram Metro Zone) said, Bhola was arrested from Benapole on Thursday while trying to flee the country without surrendering to a lower court and brought to Chattogram on Friday.
Bhola was earlier arrested on June 27 in 2016 and jailed for several days. According to Bhola's confessional statement at that time, the firearms used in Mitu's murder was recovered from the custody of Bhola's associate Monir. Later, Bhola was made accused in Mitu murder case and arm case.
However, the High Court granted him four weeks' bail on September 15.
He recently applied for anticipatory bail before the High Court after a re-arrest warrant was issued against him, but the HC ordered Bhola to surrender to a lower court.

Mitu murder: Arms supplier Bhola arrested in Jeshore
Police on Saturday arrested Ehteshamul Haque Bhola , who allegedly supplied arms used in the killing of former police superintendent Babul Akter's wife Mahmuda Khanam Mitu, from Benapole in Jeshore district.
Santosh Chakma, the investigative officer in the case and PBI Inspector (Chattogram Metro Zone) said,” Members of Police Bureau of Investigation (PBI) arrested him early Saturday while he was fleeing to India.”
There is substantial evidence that Bhola provided the firearms and ammunition for killing Mitu.
He was earlier arrested and jailed for several days.
However, the High Court in September granted him four weeks' bail.
He recently applied for anticipatory bail before the High Court after a re-arrest warrant was issued against him, but the HC ordered Bhola to surrender to a lower court.

But Bhola tried to flee the country without surrendering to the lower court.
Tipped off, PBI conducted a drive and arrested Bhola from Durgapur Bazar Road in Benapole Bazar along the border.

Mitu murder: Court rejects bail plea of husband Babul Akhter
A Chattogram court on Wednesday turned down for the second time the bail plea of former police superintendent Babul Akter being held in jail in a case over the murder of his wife Mahmuda Khanam Mitu.
Chattogram Metropolitan Session Judge Sheikh Ashfaqur Rahman passed the order virtually, said Sheikh Iftekhar Saimul Chowdhury, a counsel of Babul.

Earlier on August 10, Chattogram Metropolitan Magistrate Shafi Uddin also denied bail to Babul in the case.
Babul, who served SP of Chattagram, has been in Feni District jail since May 17.

Ex-SP Babul placed on 5-day remand
A Chattogram court on Wednesday placed former superintendent of police Babul Akter on a five-day remand in a case filed over the killing of his wife Mahmuda Khanam Mitu in 2016.
Chattogram Metropolitan Magistrate Sarwar Zahan passed the order when police produced him before the court soon after a case was filed against him, said Babul’s counsel Anisul Islam.
Earlier, in the day, a case was filed against eight people including Babul Akter as PBI found Babul’s involvement in the murder.
Mitu’s father Mosharraf Hossain filed the case with Panchlaish Police Station on Wednesday noon, said officer-in-charge of the police station Abul Kashem Bhuiyan.
In the case statement, Mosharraf claimed that Babul killed his wife over extra marital relationship.

The other accused in the case are—Musa, Kalu, Ehteshamul Bhola, Munir, Saidul Islam Shikdar alias Sakku, Shahjahan, Anwar and Wasim.
Musa, who directly took part in the killing as per the directive of Babul , remained absconding.
PBI also found that Babul made phone call and send messages to Musa after the murder of Mitu.
However, PBI submitted the report of the case filed by Babul Akhter before the court.
Already Babul’s two friends Gazi Al Mamun and Saiful Islam made confessional statement before the court under section 164, said PBI source.
Earlier, PBI detained Babul Akter following an investigation that made it clear that he had involvement in his wife's murder.

Ex-SP Babul Akter finally held over 2016 murder of wife Mitu
The Police Bureau of Investigation (PBI) has arrested former Chattogram Superintendent of Police (SP) Babul Akter in connection with the 2016 murder of his wife Mitu in broad daylight in the Port City.
The arrest took place Tuesday, when he was taken to Chattogram from Dhaka for interrogation by PBI.
PBI inspector Santosh Kumar Chakma said Babul Akhter was interrogated at the PBI metro regional office in Pahartali before he was arrested.
On the morning of June 5, 2016, Mitu was hacked to death at the GEC Mor area in Chattogram as she went to drop her son at his schoolbus pickup point.
In the immediate aftermath of the incident, a narrative was fed by Akter, a highly-decorated officer for his role in the police's long-running effort to eliminate extremism and militancy, and his supporters to depict Mitu's death as a revenge killing by the extremist elements - despite practically no precedent to suggest such a motive.
Akter, who was in Dhaka at the time, returned to Chattogram and filed a murder case against unidentified persons at Pachlaish Police Station, alleging his wife may have been killed for his anti-terrorist activities.

The case however took a sensational turn after investigators uncovered the involvement of a 'source' - underworld elements used by police officers to keep tabs on society's criminal underbelly - used by Akter. Although his fellow police officers learned enough at the time reportedly to refuse working with Akter, he was let off the hook with merely the loss of his career in law enforcement.
The case was transferred to the PBI from the Chattogram Metropolitan Police in 2019, after Mitu's father, himself a retired police officer, filed a complaint against the CMP's handling of the case.
Akter was called in for questioning a number of times by PBI since the transfer, but never placed under arrest. The PBI is yet to reveal what changed to compel the step taken today.
