Mitu Murder: HC dismisses writ challenging charge framing against ex-SP Babul
The High Court on Tuesday (May 09, 2023) dismissed a writ petition filed by former Superintendent of Police Babul Akhter challenging the legality of framing charges against him in the murder case of his wife Mahmuda Khanam Mitu.
The HC bench of Justice SM Kuddus Zaman and Justice Shahid Noor Uddin passed the order.
Now there is no legal bar to continuing the trial proceeding against him in the judicial court.
Deputy Attorney General Sujit Chatterjee Bappi represented the state while Advocate Mohammad Shishir Monir appeared for Babul Akhter.

Earlier on March 13, a Chattogram court framed charges against seven people including Babul Akhter in Mitu murder case. Later, Babul Akhter appealed to the High Court challenging the validity of it.
On June 5, 2016, Mitu was stabbed and shot dead when she was walking her son to his school bus stop at the port city's GEC intersection.
On June 6, 2016, Babul filed a case with Panchlaish Police Station.
On September 13, the Police Bureau of Investigation (PBI) pressed the charges against Babul Akter and six others in a case filed over the killing of his wife Mahmuda Khanam Mitu.

Abu Zafar Md Omar Faruk, inspector of PBI and also the investigation officer of the case, submitted the chargesheet to the prosecution unit of the Chattogram court.
The case was transferred to the Police Bureau Investigation (PBI) in 2019 after Mitu's father, himself a retired police officer, filed a complaint against the CMP's mishandling of the case.
On May 12, 2021, the PBI submitted its final report and arrested Babul Akter in another case filed by Mitu’s father and since then he has been in prison.
Babul Akhter also filed a no-confidence petition against the PBI report on October 14, 2021.

On November 3 last year, a Chattogram Court rejected the final report of PBI in the murder case and ordered it to conduct further investigation.

Ex-SP Babul placed on one-day remand
A Dhaka Court has put former Superintendent of Police (SP) Babul Akter on a one-day remand in a case filed by Police Bureau of Investigation (PBI) Chief Banaj Kumar Majumder under the Digital Security Act (DSA).
Judge Arafatul Rakib of Dhaka Metropolitan Magistrate Court passed the order after hearing on Thursday.
When Police sought a seven-day remand Shishir Monir, lawyer of the accused, opposed the remand prayer and requested for bail.

After hearing both sides, the court rejected the bail plea and put him on remand.
Earlier in the morning, Babul was brought to the court from the central jail in Keraniganj.
Later, Dhaka Metropolitan Magistrate Ashek Imam accepted police’s request to show Babul arrested in the DSA case.
Md Rabiul Islam, Inspector (Operation) of Dhanmondi Police Station and the Investigation Officer (IO) of the case, filed a petition to take Babul on a seven-day remand on Wednesday, citing three reasons including proper investigation of the case.
On September 27, Jahangir Alam, Superintendent of Police (SP) of PBI (Dhaka Metro North), lodged a complaint against four people under the DSA with Dhanmondi Police Station on behalf of Banaj, which was later turned into a case.
The other three accused in the case are Md Habibur Rahman Labu, brother of Babul, Md Abdul Wadud Mia, father of Babul and journalist Ilias Hossain.
Ilias had published a video on his Youtube channel regarding the Mitu murder case some days ago, in which he had alleged that Banaj had intentionally implicated Babul in the case and the latter was tortured in custody.

Dhaka court asks jail authorities to produce ex-SP Babul on Nov 10
A Dhaka court on Sunday asked the jail authorities to produce former Superintendent of Police (SP) Babul Akhter before it in a case filed by Police Bureau of Investigation (PBI) Chief Banaj Kumar Majumdar under the Digital Security Act.
Dhaka Metropolitan Magistrate Md Ashek Imam passed the order following a petition by a counsel of the accused for showing Babul Akhter arrested in the case.

The court also fixed November 10 for the hearing of the plea in presence of Babul Akhter.
The court also deferred the submission of the probe report in the case to December 8 which was scheduled to be submitted today.
On September 27, PBI Chief Banaj Kumar Majumdar filed the case accusing four people including Babul Akhter on charge for making ongoing investigation on Mitu murder questionable, spreading false information and throwing abusive words.
Banaj Kumar, also an additional inspector general of police, lodged the case at Dhanmondi police station.
The other accused in the case are US expatriate and Youtuber Elias Hossain, Babul’s father Md Abdul Wadud Mia and brother Md Habibur Rahman Labu.
Of them, Elias was made the prime accused in the case.
In the case the plaintiff alleged that all the accused intentionally spread false information to make objectionable the ongoing investigation of Mahmuda Khatun Mitu murder case through social platforms including Youtube.
Besides, Elias from the US spread misleading information to spoil communal harmony of the country and tarnish the image of PBI, the statement said.

PBI in an investigation found Babul’s involvement in his wife's murder.
On September 25 this year, a Chattogram court rejected a plea filed by Babul seeking its permission to file a case against six officials of Police Bureau of Investigations (PBI) including its chief Banaj Kumar Majumdar for torturing him in police custody.
The court also rejected two separate petitions for recording statement under Section 200 bringing Babul Akhter to the court and seeking security in Feni prison cell.

Ex-SP Babul appeals for security after OC searches his prison cell
Former Chattogram Superintendent of Police (SP) Babul Akter appealed to court seeking security for life alleging Officer-in-Charge of Feni Model police station searched his cell in Feni jail without permission from district magistrate or court.
On behalf of Babul, who is in jail in a case over the killing of his wife Mahmuda Khanam Mitu in 2016, his counsel advocate Golam Mowla Murad submitted the appeal to Chattogram Metropolitan Session Court Judge Dr Jebunnesa Begum on Monday.
However Feni model police station OC Nizamuddin denied the allegation brought against him when contacted by the UNB reporter.

Babul’s counsel Murad said, “ On September 10 at 12pm OC Nizam Uddin went to Feni jail and searched Babul’s cell for a long time. According to jail code, it is a punishable offence for a police officer appointed with a police station to enter jail and search a prisoner’s cell without permission from district magistrate or court.”
According to Babul’s lawyer the search was done to keep his client under mental pressure as on September 8 he lodged a complaint against six officials of Police Bureau of Investigations (PBI) for torturing and attempting to kill him in police custody.
Investigation in the incident and direction to Feni jail superintendent for providing security to Babul has been sought in the appeal made to court, he said.

OC Nizam Uddin said, “On Sunday I went to Feni jail Superintendent’s room for another case related issue but not about Babul’s case. I didn’t search any prisoner’s cell, breaching the jail code.”

Ex-SP Babul placed on 5-day remand
A Chattogram court on Wednesday placed former superintendent of police Babul Akter on a five-day remand in a case filed over the killing of his wife Mahmuda Khanam Mitu in 2016.
Chattogram Metropolitan Magistrate Sarwar Zahan passed the order when police produced him before the court soon after a case was filed against him, said Babul’s counsel Anisul Islam.
Earlier, in the day, a case was filed against eight people including Babul Akter as PBI found Babul’s involvement in the murder.
Mitu’s father Mosharraf Hossain filed the case with Panchlaish Police Station on Wednesday noon, said officer-in-charge of the police station Abul Kashem Bhuiyan.
In the case statement, Mosharraf claimed that Babul killed his wife over extra marital relationship.

The other accused in the case are—Musa, Kalu, Ehteshamul Bhola, Munir, Saidul Islam Shikdar alias Sakku, Shahjahan, Anwar and Wasim.
Musa, who directly took part in the killing as per the directive of Babul , remained absconding.
PBI also found that Babul made phone call and send messages to Musa after the murder of Mitu.
However, PBI submitted the report of the case filed by Babul Akhter before the court.
Already Babul’s two friends Gazi Al Mamun and Saiful Islam made confessional statement before the court under section 164, said PBI source.
Earlier, PBI detained Babul Akter following an investigation that made it clear that he had involvement in his wife's murder.

Santosh Kumar Chakma, the investigating officer of the case, said Babul himself came to the PBI office in Mansurabad on Tuesday afternoon to check the progress of the murder case.

Soon after the crime, Babul had filed a murder case with Panchlaish Police Station against three unidentified men.
Later, police arrested four people, including Abu Nasur Gunu, Shah Zaman alias Robin, Md Anwar and Md Motaleb Mia alias Wasim, from different places in connection with the murder.
Of them, Anwar and Wasim made confessional statements before a magistrate, implicating seven people, including Musa who directly took part in the killing, Mohammad Rashed and Nabi.

During the course of the probe, police had also arrested "arms supplier" Ehteshamul Haque Bhola and his assistant Md Monir and seized a pistol from their possession.
Police had also arrested Musa's elder brother Saidul Shikder Shakur and Shahjahan for providing the motorbike that was used in the murder. But on July 4, 2016, Nabi and Rashed were killed in a gunfight with police in Rangunia.
The case was transferred to the PBI in 2019, after Mitu's father, himself a retired police officer, filed a complaint against the CMP's mishandling of the case.
Mitu's father had, in fact, accused Babul of being directly involved in the murder case. "He (Babul) should be implicated in the murder case... if he's not, we'll go to the court,” he said.
