A bench led by Chief Justice Syed Mahmud Hossain passed the order.
Attorney General AM Amin Uddin and Deputy Attorney General Bishwajit Debnath stood for the state while Advocate Khandaker Mahbub Hossain represented the accused.
Khandakar Mahbub said one of the current justices of the Appellate Division had earlier dealt with the case when he was a judge of HC division.

The leave-to-appeal petition was dropped from the list as legally they can’t hear it, he said adding that the appeal will be heard after forming the next bench.
Ahsanullah Master was a central leader of Bangladesh Awami League and a member of Parliament from Gazipur-2 constituency.
